When I traded up my Laser a year ago I kept the best sails for myself and sold the old boat with a couple of usable sails.
This means i am currently racing with my 'old' sail number on a much newer hull. It is quite common. We also have a number of Fireballs that have sails that do not match the boat where second hand sails have been purchased.

Asking "how old are the used sails" when responding to the ad could be a good plan.

Exactly, what matters is the seller is giving a fair description of the sails. It really doesn't look like they are out to deceive.

does it matter if they are older? Surely condition is more important that age. I have seen some very tired nearly new sails and some good condition very old sails.

They'll be the "best" sails off his last boat.
I do this, theres no point wrecking a set of new sails over the winter.

It's not obvious they're older. Either way you're making an assumption which can lead to disappointment, much better ask and know for sure.

If all of the sails were older then question it, but as one set were new then it should be obvious that the previous owner either had them from an earlier boat or bought some second hand ones to preserve the set that came with the new boat. I really don't see what the issue is here

No I'd expect all of the sails to be the same age as the hull or newer.

I'd expect the rags to be older than the boat too. Think its unanimous.
