I believe it is the case. not just at a gate. but i did get muddled up as of course the racing line is tight into a windward mark. my bad.

no the latest rules allow you to more room so that you can take a a racing line, i.e. outside in.

you could probably claim that he is tacking in your water though. certainly with that pic as evidence
