Of course you can build one, but what the point if you're desire is to race with other, similar designed Merlins. I understand why people might immediately feel that the whole affair stinks, but if you think about the conseqences, the only path not letting new builds in is oblivion. Wooden boats don't last forever. Much better to set up a transparent structure which deals with the situation, gets MORE people in to support a scene which clearly has an appeal!
 
BTW - I'm talking about new builds build to a vintage design, not 'claiming to have a vintage boat because you've used an old screw'
