I could be wrong but I thought a boat could be panlised by the race committee with need for a protest? They are of course entitled to appeal.

I will have a flick through the rule book, I still say the best first course is to try and talk to them off the water first, it is possible they did not realise what they were doing.

Glad to hear that someone is reading the rule book. Surprisingly few people do.

The race committee can only penalise a boat without a hearing in application of rules 30.2, 30.3, 67, 69, A5 and P2.

In the case of Rule 42 a race committee can protest but there must be a hearing. If the SIs stipulate that Rule 67 or Appendix P apply the Protest Committee can peanlise a boat without a hearing.

I consider that a good option is to invite an experienced judge to spend the day out on the water and let him have a quiet word with competitors who may be infringing Rule 42. Then, if they do the same thing a week later - protest!
