I've never done a race where it hasn't been a requirement have this, so you'd hope so.

Recent JJ had the line set for the final race so that port end was almost on an island and everyone started at the starboard end to avoid the shallows.
Given that the boat in question had boards which could be raised to avoid the bottom, then this is clearly down to the sailor. I suspect the sailor thought the owner would stump up and is now regretting his stupidity.

This is all very interesting. I did an RS200 nationals at Hayling a few years back, the race course was set in water about 20ft deep, not a problem when upright but it was quite wavy that day and boats that capsized ended up pile driving their masts into the bottom and bending them. That day about 6 masts were bent beyond repair, someone had to drive to LDC that night and collect a load of replacements. I was one of those with a bent mast and a guy came over and asked who I was insured with, when I said Noble he said he worked there and that Noble would pay out no bother, they did. I very much doubt any competitor or Noble decided to make a claim against the club for this, its just one of those things.
The next day they moved the race course into deeper water (possibly because there wasnt any more spare masts at LDC!).

Funny, that sounds like the last RS400 open at HISC, which we sat out while our mates bent their boats.
Or the Merlin Nationals there in 2011.
But if you kept the boat upright and didn't go out in conditions you could not cope with, you were ok.
Noble will pay out, but watch the premium rise.

bit off on a tangent... but where would you stand if you left your boat tied down in the boat park to find those members who don't have to work have gone down during the week and cut the grass.... and not tied your boat back down...... who is responsible then???

our club line has parts of it that are allways to shallow to start on as it runs from a transit on the shore. So I am sorry but helm responsibility.
Most of the Solent will bend your mast when inverted except the shipping lanes so no real choice for race officers, but then so will many inland venues.

I borrowed a boat last year for a nationals( no money changed hands so it wasnt a charter). The boat was insured 3rd party by the owners but I wasnt happy so tried to insure it comprenensively. This wasnt possible as it was already insured by the owner. We came to the agreement that he would upgrade the insurance and I would pay the extra premium of £20. As it happened the boat did get damaged and we were both pleased we had taken out the extra insurance. I paid the excess on the repair.
It seems to me that the charterer in this case didnt ensure he was covered sufficiently and to continue to sail once the boat was damamged was just stupid.
I cant see that the club can be liable for someone not ensuring he was properly covered.

Sounds like the boat wasn't insured to start with, no different from driving a car without insurance and therefore "the book" should be thrown at the person trying to claim against the club. This skipper is a danger to his/her crew and all other competitors, thankfully it was only damage to the own crafts dagger board.

In my opinion I would report them to the RYA as failing to comply with the entry of the regatta!

I'm surprised they continued racing knowing that dagger boards were jammed down. How were they planning to come ashore?. If it's where I think it is, that would have been interesting.
 
I race at Sheppey so hands off our RTI ! When it's shallow, raise the boards. How difficult is it for Gawd's sake! I don't want to start sailing with my lawyer in tow.
