i once had to save one of the passengers of a jet ski when out sailing on my laser. hes lucky i wasnt racing otherwise i would of left him.

omg so does all our sailing gear make us really fashionable. i hope it doesnt catch on as the companys will put there prices up and then it will be stupidly expensive to buy the gear

I think you might have a legal (and certainly moral) duty to provide assistance if he was at risk of serious injury or death. Just as if you're racing and someone in the race is obviously in trouble you have a duty to provide assistance if able. What do you think the coroner would have said if you'd sailed past and he'd subsequently drowned (or the media)?

If you were racing and had left him you would be disqualified under rule 1.1,
"1.1 Helping Those in Danger
A boat or competitor shall give all possible help to any person or vessel in danger."

and then in addition almost certainly cop a rule 69.1 hearing...

"69.1 Action by a Protest Committee
(a) When a protest committee, from its own observation or a report received from any source, believes that a competitor may have committed a gross breach of a rule, good manners or sportsmanship, or may have brought the sport into disrepute, it may call a hearing. The protest committee shall promptly inform the competitor in writing of the alleged misconduct and of the time
and place of the hearing.
(b) A protest committee of at least three members shall conduct the hearing, following rules 63.2, 63.3, 63.4 and 63.6. If it decides that the competitor committed the alleged misconduct it shall either
(1) warn the competitor or
(2) impose a penalty by excluding the competitor and, when appropriate, disqualifying a boat, from a race or the remaining races or all races of the series, or by taking other action within its jurisdiction. A disqualification under this rule shall not be excluded from the boat’s series score.
(c) The protest committee shall promptly report a penalty, but not a warning, to the national authorities of the venue, of the competitor and of the boat owner."

The National authority may then take further action, including a report to ISAF.

A recent example was this one:-
"During a race for the J-24 class on October 19, 2002, part of the Semana de Buenos Aires Championship Regatta 2002, a boat skippered by Mr Magdalena and crew suffered a “knockdown” resulting in the crew falling into the water. The boat recovered from the knockdown but one of the crew remained in the water. As a result of the strong wind and waves at the time the boat was driven downwind and became separated from him. Mr Majdalani and the remaining crew did not make any attempt to rescue the crew member from the water. Fortunately the crew member that became separated from the boat was picked up by another boat in the regatta."

The skipper got a three and a half year ban from all ISAF events, the rest of the crew two years.

So probably best to pick the moron up!

terran since we both sail radials with an amazing hull grafixs design (the best ever by laser) i'm on ur side mate, people can't really coment cos there were not there. but u did pick up the passenger n take him back to the beach just like anyone else would have. we all know its a moral duty to help someone in distress we don't need bashing with the rule book
