That is them coming out of a roll tack .. the helm is about to move upto the new windward side and squeeze the both both forwards and upright.

That is correct you can't gain speed but to can get back up to speed. 

  1. A boat’s crew may move their bodies to exaggerate the rolling that facilitates steering the boat through a tack or a gybe, provided that, just after the tack or gybe is completed, the boat’s speed is not greater than it would have been in the absence of the tack or gybe.

Edit. I assume one of you did a 720 for hitting the 400 and 360 for the committee boat ...

Also I believe the 400 would be penalised for not giving room to a give way boat and causing serious damage. 

Not so sure I remember seeing any rule which says your suppose to sail into a boat you have no rights over possibly risking injuring a hiking Merlin crew just to allow another boat to get further into somewhere it shouldn't have been in the first place!!

GENERAL LIMITATIONS
14 AVOIDING CONTACT
A boat shall avoid contact with another boat if reasonably possible.
However, a right-of-way boat or one entitled to room or mark-room
(a) need not act to avoid contact until it is clear that the other boat
is not keeping clear or giving room or mark-room, and
(b) shall be exonerated if she breaks this rule and the contact does
not cause damage or injury.

Your words;

Now insert a helm and crews bum into that couple of feet, also bear in mind you were going substantially quicker than we were and also a boat turns around its centreboard and I was looking where I was going, by the time I was aware of where you were, had I born away it would only have swung the corner of my transom into you harder, and instead of having 1 damaged boat you were liable for, you could have had 2 and maybe a Merlin as well!! As it is you only hit us a glancing blow and its only your own boat damaged and nobody was hurt!!
