An interesting thread (and I've just read it all). Clearly Jamie recognises he was wrong and has changed his mind about claiming.

However, I tend to think his reaction, to claim against somebody else is becoming driven into people in the UK by the frequent and continuous TV "no win no fee" type advertising which seems to suggest that when something happens to you you claim against somebody else for money. With such a barrage of "claim, claim, claim" publicity going on I am not surprised by the original question. It is part of the price the UK is paying for becoming Americanised.

In fact it is more than just UK becoming Americanised. Research has shown that younger generations are being over protected from risk. Children are no longer being allowed out to learn by mistakes. When I was a kid used to spend ages falling off things and getting hurt and apparently this is a critical part of the learning process. These days "health and safety", etc. is stopping children from such activities, school trips are often too great a risk and anything minor "goes wrong" and the teacher is subject to enquiries, etc. The result is that they have a greater need to feel "looked-after" (the nanny state being sought). Part of this is accidents not being "your fault" and claiming against them i.e. there is always a safety net for you. (Not for one moment suggesting Jamie is in this category but talking generally here).

Activities like sailing are really fantastic as they encourage learning by experience, getting it wrong, "falling over" and learning to stand on one's own two feet - and actually in a fairly protected environment. Get everybody out sailing.

Interesting thread, the only disagreement being how soon to stop kicking you Jamie! Luckily you weren't in a rotomoulded boat or they'd have been demanding the death penalty...........

FWIW we've been retrieved off our turtled boat as it drifted towards the dam, in a  squall that knocked everything with a sail over.  Seem to remember the safety boat helm saying "get in, the boat's insured but your'e not."  He did go back and retrieve it or us once we were safely ashore tho.

Such venemous sounding replies to your original simple question Jamie ! Trouble with insurance claim forms is that they are so often poorly worded.Cant see how you can answer that liability question honestly! So much good advice from the other posts that I wonder if they can come up with some useful suggestion. I note that one post stated that their club is considering doing away with the term RESCUE BOAT. correct me if am wrong but I thought that the term WAS changed some years ago due to possible litigation problems.

Well, I think Jamie did okay in the end; he's asked for advice and been good enough to take heed of the forum members.

Think the basic principal of suing someone who is trying to help you out is really "bad play" in any situation. Maybe just the thought of putting a claim in to the insurers may have influenced poor judgement...

I think poor Jamie wishes he never asked now

Don't worry Jamie I'd still fish you out (even just for the entertain value in the bar later)

Wow.

Amazing how reactionary people are on forums!

Not all chemicals are bad. Without chemicals such as hydrogen and
oxygen, for example, there would be no way to make water, a vital
ingredient in beer.

Your sins are forgiven my son.  Wear a hairy rash vest next time you sail and give yourself a good whipping with your carbon tiller extension and we can all move on.

[QUOTE=English Dave]

It was also the "getting out more" that got him
into trouble in the first place.

C'mon guys, close this thread. He's said sorry a couple of times.

Agreed - Jamie has eaten humble pie here and admitted he was wrong. Let's
move on...
