Can I just reiterate again - I don't want to sue the club, I wanted to enquire about claiming from a policy the club presumably has to protect its members What if the club memebers erected a flagpole, didn't cement the base in properly, it fell over and crushed my boat? Would I be justified in claiming for that or just 'suck it up' and claim on my policy so as not to upset the members? I suspect such a claim would be OK with most people. So really the question is where do you draw the line between justified and frivolous? On reflection the damage occured in the rescue should come off my policy, as the situation was of my own making. The only reason I was questioning it was because if the driver had approached differently, maybe he wouldn't have hit me. If there was a way that I didn't have to be £75 out of pocket, I thought it would be worth investigating. What I am amazed at is the amount of personal abuse directed at me, which I really don't feel is justified. For the record I do take responsibilty for my actions, the wet floor analogy was if someone was negligent (ie no signs and the floor wasn't obviously wet) and I were to suffer an injury (not just a fall, I mean an injury that meant hospitalisation and/or loss of earnings) I would seek to recover my own losses. I am not the sort of person that demands £100,000 for a bruised arse, just reimbursement for whatever material loss I suffered. That's called not being taken advantage of. |

who pays for the clubs policys ------ the members !!!!!!!!
and if eejitts sue clubs its us that pay , interesting thing I once found out when a member slipped on our slipway (what did he expect with a name like that ) and threatened to sue his own club RYA legal dept recconed you cannot sue your own club as its suing youself . Wether thats still the case I don't know .

I think the point you are missing is that you take responsibility for yourself when you go afloat - if you get into trouble in 40 knots then you are responsible for going out in the first place... Therefore the answer to the question is... YOU.
