Also, depending on the position of the next mark, it is possible that 18 had switched off as they were no longer rounding the mark.

The fireball definitely was taking his own fate there given that you can see that the Vago was clearly inside and overlapped even if he did muck the gybe up. 

What you cannot see, however, is what avoiding action the fireball had to take....they COULD be exonerated as the Vago clearly does not make a controlled rounding.

That is another discussion completely though.

I'm well aware of both Bainbridge and DP and their products having dealt with them both when I was in the trade.

I don't know really that you can tell much at all from that sort of fish eye lens stuff, but I'd be inclined to think that until the boat with the camera gybed the Fireball was keeping clear and could easily have been the innocent party.
