America's Cup: Make your submission on the Bases

The Auckland Council have clarified the submission process for the re-lodged/new Resource Application covering the America's Cup bases and facilities.
A letter sent by Auckland Council to those who sent submissions on the America’s Cup (AC36) and/or Ferry and Fishing Industry Relocation Facility resource consent applications is below, covering:
(a) The status of these two resource consent applications, and the status of existing submission(s); and
(b) The process for submitting on the new resource consent application for the America’s Cup recently lodged by the applicant, Panuku Development Auckland (Panuku), called ‘the Wynyard Hobson proposal’. The Wynyard Hobson proposal is described further below.
Previous resource consent applications (lodged on 15 January 2018)
The America’s Cup AC36 resource consent application has now been withdrawn by the applicant (Panuku) and will not be processed further. In its place, Panuku has lodged a new resource consent application with Auckland Council - called the Wynyard Hobson proposal.
The related Ferry and Fishing Industry Relocation Facility resource consent application is currently on hold at Panuku’s request. Panuku has been undertaking further investigatory work and is carefully considering how that application will be treated going forward. Further information on the status of the Ferry and Fishing Industry Relocation Facility application will be provided once a decision is made by Panuku.
Existing submission(s)
The Council has been looking at all the matters raised in submissions on the original America’s Cup AC36 and Ferry and Fishing Industry Relocation Facility resource consent applications.
We will continue to consider the matters raised in the existing submissions on those applications as part of our assessment of the new Wynyard Hobson proposal, where the submission points are relevant to the new resource consent application. However, please be aware that the existing submission will not be treated as a formal submission on the new application. If you remain interested in the resource consents for the America’s Cup, you are strongly encouraged to review the Wynyard Hobson proposal when it is publicly notified and lodge a new submission on that proposal.
If you do not lodge a new submission, we will still consider the matters you have raised that are relevant to the new application, but you will not be identified as a formal submitter on the new resource consent application and you will not be able to be involved in the hearing of the application.
The new resource consent application – the Wynyard Hobson proposal
All the information on the Wynyard Hobson proposal is also available on the Council’s website Wynyard Hobson proposal.
The Wynyard Hobson application will be publicly notified for submissions on 30 April 2018. All the details on how to submit on this application will be on the website listed above from 30 April 2018.
Anyone will be able to submit on the new application through the website from 30 April 2018 through to 28 May 2018. Any changes to these timeframes will be communicated through the Council’s website.
Direct referral process – Environment Court hearing
Panuku has formally requested that Auckland Council allow the application to be ‘directly referred’ to the Environment Court. Council is considering this request.
The separate notification letter being sent to you will provide information on the key steps associated with the direct referral / Environment Court process, including details of a draft timetable through to hearing.
In the meantime, the Environment Court has appointed three independent Process Advisors. The role of the Process advisor is to assist submitters, particularly around matters of process. The Process Advisors cannot provide advice on the content or nature of any submission.
Sail-World urges those who support the America's Cup being held in Auckland to lodge a new submission in support. For the first application it was a relatively simple online process which took about 10 minutes.
If you made a submission previously as an attached document, most of it should be relevant to the new Application and should just need a refresh.
Sail-World's information is that the Fishing Industry Relocation Facility application has been withdrawn and will not be resubmitted - removing quite a contentious proposal.
