I'm not sure how it stands, looking at the rules there could be further sanction from the RYA. But on the other hand the CAS has been quite clear that you can't punish people twice for the same infraction, so seeing as he has those DMG's I'm not sure what happens next.

I can completely understand where Ben was coming from on this one. This incident has cost him the World Championship but lets hope that it doesn't cost him far more. Ben's blood must have been boiling at the time and I can totally understand his anger towards the media boat.
Let's hope that the International Jury decide that his disqualification from races 9 and 10 are punishment enough for his actions after the race and the situation can be resolved without further sanctions against Ben. Having been involved myself in a Rule 69 Hearing I can say that they are a very nasty business indeed. Then can also totally disillusion you with high-level competition. I spent two very long nights in a hearing in Holland in 2003 during a World Championship and, even though the allegations against me were found to be untrue, I took the decision never to compete in a worlds again. All the best Ben, we're all with you. |

All things being equal, it's something he (and we) could do without...

Firstly let me say my heart goes out to Ben for a moment of stupidity when his blood must have been boiling. But the rules would have protected him if he was impeded in anyway...and then to sail in a race after being black flagged is an automatic DMG.
However he still can be called to answer despite scoring DMG so what will the RYA do?...wont look good them banning a member of the Olympic Team.... CAS allows for a dsq at the event and for further action to be taken IF the further action is reasonable and appropriate (yeah Im not sure on that one either)...but hey if Rooney can get away with what he did Im sure Ben can too

As i said in the other thread before seeing this one, i am not really sure why the protest should have affected the race that he had already finished. I would have thought a dsq from the event would be acceptable but to actually change a race score for an incident that happened outside of racing is a bit strange.

laser193713...its gross misconduct under rule 69 if I remember it properly you aree subject to that rule and Rule 2 from the moment you enter the compound until you leave it and you cant go round boarding media boats...and even Bens statement admitted it was a stupid thing to do.

it was a stupid thing to do but no one was hurt and I can fully appreciated his motives, the media boat was far to close, it is completely out of character (i think) so they should just leave it at that, the only other thing is that a competitor benefited from a wave (so I have herd) so shouldn't the media boat get a sanction or a sanction to the benefiting boat?
